This is a post-conviction habeas corpus proceeding under Article 11.07, V.A.C.C.P., in which petitioner seeks to set aside his death sentence and to have Article 43.14, V.A.C.C.P., establishing a new method of execution, declared unconstitutional. We stayed petitioners execution scheduled for September 16, 1977, pending disposition of these proceedings. Petitioners conviction for capital murder, wherein the death penalty was assessed, was affirmed by this court in Granviel v. State, 552 S.W.2d 107 (Tex.Cr.App.1976), cert. den. 431 U.S. 933, 97 S. Ct. 2642, 53 L. Ed. 2d 250 (1977).
